1. Who these terms are with

These Terms of Service form an agreement between you and Farpoint Technologies Private Limited, located at Aspire Coworks No.39/7-1, Third (3rd) Floor, 7th Main, Opposite Dr. Ambedkar College Ground, Appareddy Palya, Indiranagar, Bengaluru North, 560038. By creating an account or using Kaptureflo, you agree to these terms.

2. Who can use Kaptureflo

Kaptureflo is designed for commercial sellers and businesses. You must be at least 18 years of age and capable of entering into legally binding agreements to use this service.

3. Your account

You must provide accurate and complete information when registering. You are responsible for safeguarding your login credentials and for all actions that occur under your account. If you believe your account has been compromised, notify us immediately at info@kaptureflo.com.

4. What Kaptureflo does

Kaptureflo is an AI marketing assistant for online sellers. The platform assists you by drafting marketing content and preparing promotional campaigns:

• AI written email campaigns and welcome emails sent from your own email account.
• AI written WhatsApp messages and win-back offers sent through your connected WhatsApp provider.
• Meta ad plans, product-accurate creatives, and pushing campaigns to your Meta ad account as paused drafts.
• Ads dashboard showing spend, results, findings, and tracking health checks.
• Shopify connection to sync products, orders, refunds, and customer lists.
• Creative Studio creating ad images from your product photos.
• Festival campaign plans for Indian retail events.
• Attribution reporting linking ads to orders.
• Customer list segments and reviews view.
• Website tests for pages and offers.
• Content tools including post calendars, organic scheduler, hashtag tools, and reel writing tools.
• Google Ads strategy plans for keywords, ad copy, budgets, and structure as a planning tool.
• Weekly email summaries of store marketing performance.

5. You stay in control

Kaptureflo does not publish content or spend ad budget on its own. All actions require your explicit review and approval:

• Nothing is sent or spent without your approval.
• Ad campaigns are always created in a paused state in your ad account.
• You are responsible for reviewing and approving all generated text, images, and offers before they go live.
• You are responsible for complying with the advertising policies of Meta, Shopify, your WhatsApp provider, and your email provider.
• You are responsible for following applicable laws in India, including obtaining customer consent and honoring opt-out requests.

6. Your accounts and data

You connect your own store, ad account, WhatsApp provider account, and email account. Kaptureflo acts on your behalf using the permissions you grant. You can disconnect your Shopify store and Meta account at any time in the app.

7. Credits and payments

Kaptureflo operates on a credit system. Credits are deducted as you use generation and automation tools. Payments for credits are processed securely through Razorpay. We do not store your credit card or bank account details.

8. Acceptable use

You agree to use Kaptureflo only for lawful commercial purposes. You agree not to:

• Send unsolicited spam, bulk messages, or deceptive promotions.
• Send marketing messages to recipients who have opted out or requested deletion.
• Generate or distribute unlawful, fraudulent, defamatory, or infringing content.
• Attempt to reverse engineer, bypass security controls, or disrupt the platform.
• Violate terms or policies of connected services including Meta, Shopify, Google, or your messaging providers.

9. Third-party services

Kaptureflo integrates with external platforms, including Shopify, Meta, Google, WhatsApp providers, email providers, and AI services. We do not control these third-party platforms. Your use of each third-party service is subject to its separate terms and policies.

10. Content ownership

You retain all ownership rights to your product catalog, brand assets, customer records, and original materials. You grant Kaptureflo the limited right to process this content solely to provide the services you request.

The Kaptureflo software, design, logos, trademarks, and documentation belong exclusively to Farpoint Technologies Private Limited.

11. Ending your use

You may stop using Kaptureflo at any time. You can disconnect integrations in your settings and request full account and data deletion by visiting our Data Deletion page.

We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or fail to comply with applicable marketing laws.

12. Disclaimers and liability

Kaptureflo is provided on an as-is and as-available basis. While we strive to provide reliable recommendations, we do not guarantee sales volumes, advertising returns, or conversion rates.

To the maximum extent permitted by applicable law, Farpoint Technologies Private Limited will not be liable for indirect, incidental, special, or consequential damages resulting from your use of or inability to use the platform.

13. Governing law

These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these terms will be resolved subject to applicable Indian legal procedures.

14. Changes to terms

We may modify these terms as our product evolves. Revised terms will be posted on this page with an updated Last updated date. Continued use of Kaptureflo after changes take effect indicates your agreement to the updated terms.
